Video Contest Rules


Official Rules


1. Eligibility:
  • NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Contest (as defined below), registrants ("Entrants") must be permanent, legal residents of the fifty (50) United States, at least sixteen (16) years old at time of entry and of the legal age of majority in their state of residence (or if not of legal age of majority, submit a completed, signed Parental Consent Form with entry) and be the Authorized Account Holder (as defined hereinafter) with respect to the e-mail address submitted on his or her account registration form. The rules governing contests and tournaments with prizes are set up by each individual state, not by the federal government. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. By entering the Contest, Entrants agree to be bound by these Official Rules and the decisions of the Sponsors (as defined below) and/or judges, which decisions are final and binding in all respects.  Employees, officers, managers and directors of Revere America, their parents, subsidiaries and affiliated companies, advertising and promotion agencies, web masters and web suppliers, (the foregoing are referred to collectively as the “Sponsors”), their respective immediate family members (parents, spouse, children or siblings, wherever they reside) and persons living in their household (whether or not related) are not eligible.

2. Contest:
  • 2.1 The term "Contest" shall mean the “Revere America" Contest created and available on the RevereAmerica.org web site (“the “Site”).

3. To Enter: Entrants must submit their Contest Material (defined below) following the steps below:
  • 3.1. Go to http://www.revereamerica.org
  • 3.2. Complete the registration form. Entrants will be asked to submit their name, city, state, ZIP code, age, gender, phone number, and email address.  Entrants will also be asked to select a username and password. (Note: Entrants are solely responsible and liable for all actions taken under any usernames or passwords.) Within a few minutes, Entrant will receive an automatic email from the site to confirm authenticate and confirm their registration. Follow the instructions inside the email to activate Entrant’s account.

4. Contest Materials Submission: "Contest Materials" are described on the Entry Submission page and are as follows:
  • 4.1. A YouTube link to one (1) video of no more than a sixty (60) second length.
  • 4.2. A brief description of the Entrant and/or the submission.
  • 4.3. A fully completed, signed Parental Consent Form if the Entrant is not the legal age of majority in his or her state of residence.
  • 4.4. Entrants are allowed to submit two original Entries, but duplicate entries will be excluded.

5. About the Contest Materials and How To Submit the Contest Materials:
  • 5.1. On the Entry Submission Form, Entrants will be asked to select an Entrant/Entry Name, which should not be Entrant’s username or password. This name will be used to publicly identify Entrant in the Contest. Entrant will also be asked to complete a brief description of his/herself or a description of his/her Entry. Entrant will also have the option to complete a longer detailed essay about his/herself or submission. The detailed essay/description cannot exceed five thousand (5,000) characters and must be truthful and accurate in all respects. For both the brief description and essay, if the allowed character count is exceeded Entrant will be immediately notified.  This is also the page on which Entrant must upload his/her other Contest Material as directed.
  • 5.2. If Entrant’s video file does not play, is corrupted, or is unable to be viewed by the judges for any reason, or if Entrant is unable to upload his/her video file for any reason, Entrant absolves and releases the Sponsors from any responsibility and has no rights of special entry to the Contest. The Sponsors shall not be responsible or liable for failed uploads, system downtime or other difficulties in successfully receiving and recording Entrant’s Contest Materials or any part of Entrant’s Contest Materials, or making Entrant’s Contest Materials available to users of the Site or the judges.
  • 5.3. No entries other than those submitted in compliance with these Official Rules will be accepted.
  • 5.4. The Sponsors reserve the right to cancel or reject any Contest Materials for any reason or for no reason. Examples of reasons why the Sponsors may reject Contest Material include, but are not limited to, files are indicated or believed to contain a virus or any other feature which a Sponsors deem (in their sole discretion) to be potentially harmful; any Contest Materials, or any part of any Contest Materials, which a Sponsor deems (in its sole discretion) to be inappropriate for publication/broadcast; and Contest Materials or any part of any Contest Materials, which Sponsors deems (in its sole discretion) not desirous for association with the Sponsors or their brands and products; and failure to submit a required Parental Consent Form.
  • 5.5. Contest Materials must not infringe on any third-party's rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material, may not contain defamatory statements, may not violate privacy, publicity or other rights of any person, firm or entity, may not in any other way violate applicable laws and regulations, and may not contain any copyrighted works (other than as owned by the Entrant), in each case, as determined by the Sponsors in their sole discretion.  The Submission must not have been previously published, submitted, distributed or aired.  The Submission may not contain material that violates or infringes the rights of others, including, but not limited, to privacy, publicity or intellectual property rights (including copyright, trademark or patent rights) or constitutes copyright or trademark infringement.  The Submission may not contain copyrighted music, images, footage, artwork or videos not owned by Entrant.  The Submission may only contain music created by the Entrant.  Use of anything that is not the Entrant’s own original work may result in disqualification.  The Submission may not contain any trademarks, logos, or other intellectual property of others.  Entries containing prohibited or inappropriate content as determined by the Sponsors, in their sole discretion, will be disqualified.  The Sponsors retain the ultimate decision, in their sole discretion, as to which Entrants and Contest Materials are eligible. Upon submitting any Contest Materials, the Respective Entrant grants the Sponsors and its agents the unconditional, unlimited, irrevocable, perpetual, royalty-free, non-exclusive, transferable right and license to use, publish and copyright their name, voice, photograph, video images, likeness, and biographical data as set forth in the Contest Materials, in whole or in part, in any and all media now known or hereafter developed throughout the world in perpetuity.
  • 5.6. Entrants that do not include all required information and all required Contest Materials or that fail to adhere to the Official Rules will be considered void and will not be eligible for consideration in this Contest.
  • 5.7. By submitting an entry or any Contest Materials, Entrant agrees to the Terms of Use specified on the Site and further agrees not to sue or assert any claim against any Sponsors in connection with the Contest or any use of any Contest Materials; provided, that if applicable law prohibits such a covenant, release or waiver of claims, Entrant hereby waives the right to seek or accept damages in any proceeding and to reimburse the Sponsors for any and all expenses or costs associated with such claim (including attorneys fees, court costs and the amount of any judgment or settlement).
  • 5.8. This Contest is governed by the laws of the State of Florida, with venue in Collier County, Florida, and all claims must be resolved in the federal or state courts located in Collier County, Florida.
  • 5.9. The Sponsors may, in their sole discretion, remove, delete and/or disqualify any entries or any Entrant deemed to be inappropriate, ineligible or otherwise non-compliant.
  • 5.10. Regarding the Contest Materials, the respective Entrant represents and warrants that (a) the essay is truthful and accurate in all respects, (b) the video recording is an original work of, and belongs entirely to, the Entrant (c) the Contest Materials do not violate any law, regulation or any right of any third party, including but not limited to rights of patent, copyright, trademark, publicity or privacy or portrayal in false light, and do not contain material which is defamatory, slanderous, threatening, inflammatory, or libelous, (d) the Contest Materials are Entrant's own original work and no third party has contributed to the Contest Materials in any manner whatsoever (except only for a videographer for the video submitted, in which cases the Entrant has secured in writing ownership of or permission to use those Contest Materials so as to permit Entrant to grant the rights and licenses granted in these Rules); and each Entrant understands that his/her Contest Materials must comply with all of these conditions in all respects. Copyrighted or obscene or objectionable material is subject to disqualification at any point in the contest at the sole discretion of the Sponsors.
  • 5.11. By submitting Contest Materials each Entrant grants permission to post his/her name, and the Contest Materials on the Site for purposes of the Contest and further grants to the Sponsors the unconditional, unlimited, irrevocable, perpetual, royalty-free, non-exclusive, transferable right to publish, display, broadcast, reproduce, use, sublicense (through multiple tiers) adapt, edit and/or modify, and create derivative works from, any such Contest Materials and Entrant’s name, in any way, in any and all media whether now or hereafter known, without limitation and for any purpose (including commercial purposes), and without consideration to the Entrant, whether or not such Contest Materials are selected as a winning entry, along with the right of attribution. Each Entrant warrants and represents that he/she has obtained in writing all rights, approvals, releases and/or consents necessary to submit the Contest Materials in the Contest, and grant the stated permission to post the Contest Materials (for example but not limited to rights of a videographer who has taken the video of Entrant submitted by the Entrant or the rights of publicity of persons other than Entrant appearing in the video) and that should Sponsors at any time request that any Entrant provide any such rights, approvals and/or consents in written form, Entrant will provide them in written form in the time specified in that request.
  • 5.12. By submitting Contest Materials the Entrant warrants and represents that he/she is not signed to a contract or bound by any other obligation that would prohibit entering or participating in the Contest or complying with the Official Rules. Entrants further agree not to bring any copyright infringement action or other related claim against any Sponsor arising from or relating to the Contest Materials.
  • 5.13. The Sponsors, at their sole discretion, reserve the right to reject any submission deemed to be a duplicate entry.
  • 5.14. Upon Entrants uploading the Contest Materials to the Site, Entrants assign all of their rights, title and interest, including the copyrights, in and to the Contest Materials to Revere America for their use in any and all manners and mediums now known or hereinafter devised. Entrants may not request that their Entrant Materials be removed from the Site after it has been uploaded. To submit Contest Materials, follow the instructions on the web site.
  • 5.15  Sponsor reserves the right to cancel, modify, or suspend the Contest in its sole discretion.  Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that term.
  • 5.16  By submitting an entry, each Entrant to the extent permitted by law, consents to the use of the Entrant’s name, likeness, and/or biographical data for purposes of advertising, publicity, fundraising, promotion and sales by Sponsor without further consent, compensation or approval.  However, entries are not guaranteed to appear in any communication of Sponsor and Sponsor shall not incur any liability to the extent Sponsor chooses to refrain from using such information or entry.

6. Contest Entry Fee:
  • 6.1. Submissions to the Contest are FREE.

7. Contest Timeline:
  • 7.1. The Contest submission period shall start on May 4, 2011 at 12:00 PM EST and end on August 4, 2011 at 5:00 PM EST.
  • 7.2. After the submission period ends, all Entrants who have successfully uploaded all required Contest Materials and other information as outlined above will be evaluated by the Contest Judges.  Twenty (20) videos will be selected by the Contest Judges as Contest Finalists.
  • 7.3. Judges will evaluate all videos on the following objective judging criteria: Creativity, Originality, Production Values, Popularity and Use of Brand.
  • 7.4. Registered users will then vote on the Contest Finalists over a thirty-day voting period.  The outcome of this voting will determine the Contest winners.

8. Contest Winners:
  • 8.1. Each registered user can vote for the Contest Finalist of their choice a maximum of once throughout the Contest voting period.  The votes of the registered users (“Popularity”) will determine the Contest winners.
  • 8.2. At the conclusion of the thirty-day Contest voting period, one (1) grand prize winner and five (5) runners up will be selected based on the outcome of this voting.

9. Prizes:
  • 9.1. One (1) grand prize winner will receive the following grand prize (“Grand Prize”): $5,000
  • 9.2. Five (5) runner-up winners of the Contest will receive the following runner-up prizes (each a “Runner-Up Prize): $1,000

10. Contest Winner Conditions:
  • 10.1. Sponsor reserves the right to substitute a prize with another prize of greater or equal value in the event the offered prize is unavailable. Prizes are not transferable and may not be redeemed or exchanged for cash or other alternative goods or services.  Award of prizes will be made upon written acknowledgement of, and full compliance with, the requirements listed herein. Winners must satisfy all eligibility requirements before they may be awarded any prize. Winners are responsible for all applicable federal, state, and local taxes, registrations, and other fees and assessments, including any required insurance. Winners are solely responsible for any taxes on the prize, and, for prizes valued in excess of six hundred dollars ($600), will receive an IRS Form 1099. Prizes are non-transferable. Unclaimed prizes will not be awarded.   Each potential winner will have seven (7) days after being notified via email to respond or forfeit the prize. If a potential winner cannot be contacted within a reasonable time period, fails to respond to the email notification within the required time period or is not in compliance with these Official Rules, or prize or prize notification is returned as undeliverable, such potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion.
  • By accepting any prize from the Site, Entrants agree to allow the Site to print, publish, broadcast and use, worldwide, in any media and at any time, their name, picture, voice, likeness, and/or biographical information for promotional purposes without additional compensation.  As a condition to receiving any prize, Winners may be required to complete, execute and return an affidavit of eligibility, a liability release and, where lawful, publicity release (“Contest Documents”) within fourteen (14) days of receipt of the documents. Return of the documents or prize as non-deliverable, failure to return the Contest Documents timely, or if any Winner is found to be ineligible or not in compliance with these Official Rules may result in disqualification and awarding of the prize to an alternate Winner.  By accepting a prize, where permitted by law, each Winner grants to Sponsors (which grant will be confirmed in writing upon request of the Sponsors), and those acting pursuant to Sponsors’ direction or control the right to print, publish, display, distribute, reproduce, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web and Internet, at any time or times, the Winner's full name, portrait, picture, voice, likeness and biographical information and Contest Materials and other text or graphics provided in connection with the Contest as news or information and/or for advertising, trade and promotional purposes without additional consideration, and without review, approval or notification.

11. Indemnification:
  • 11.1  Without limiting any other provisions hereof, each Entrant agrees for Entrant and Entrant’s heirs, executors, and administrators to indemnify, reimburse and hold Sponsors, Revere America and their respective parent, subsidiary, affiliated and related entities and the officers, directors, and employees of each of the foregoing, harmless from and against any and all claims, demands, liabilities, actions, suits, proceedings, losses, damages, judgments, expenses and/or costs (including without limitation actual attorneys’ fees and related costs) (collectively, “Losses”) directly or indirectly based on or arising out of (i) such Entrant’s acceptance, possession, use or misuse, or participation in any prize (including any travel related thereto); (ii) such Entrant’s participation in any Contest related activity or in the Contest itself; (iii) the negligence, intentional misconduct or illegal actions of such Entrant, as well as any actions or omissions of Entrant resulting in or giving rise to, in whole or in part, any injuries or damages to person (including death) or property; (iv) any use of such Entrant’s Contest Materials by the Sponsor, or exercise of any other rights granted to the Sponsors by such Entrant, including such rights granted pursuant to these Official Rules and the Terms of Use; and (v) any claim that any Contest Materials or other information or materials supplied by such Entrant infringes upon the rights of any third party; and (vi) the actual or alleged breach of any representation or warranty made by such Entrant, including those contained in these Official Rules and the Terms of Use.

12. Limitations of Liability:
  • 12.1. No responsibility is assumed for lost, late, incomplete, stolen, misdirected, corrupted, unplayable, illegible or non-delivered, email or Contest Materials; or for any computer, telephone, cable, network, satellite, electronic or internet hardware or software malfunctions, failures, connections, or availability, or for garbled or jumbled transmissions, or service provider/internet/website/use net accessibility or availability, traffic congestion, or unauthorized human intervention, or the incorrect or inaccurate capture of entry information, Contest Materials or other information, or the failure to capture any such Materials or information. Revere America is not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website.  Revere America and Sponsors are not liable for unauthorized human intervention in any part of the Submission process or the Contest; printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest; the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Contest-related materials; late, lost, misdirected, undeliverable, damaged or stolen mail; any injury, loss or damage to persons or property, including but not limited to Entrant or Entrant’s computer or video equipment, which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt or use or misuse of any prize awarded; lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof; or any typographical or other error in the printing of these Rules or any materials associated with the administration of the Contest or the announcement of the prize.  Sponsor is not responsible for any unauthorized third party use of any Submission.  Revere America reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or website; to be in violation of the Conditions of Use of the website to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry or registration methods or voting methods will void all such entries by such methods, and disqualify any Entrant using such methods. Sponsors are not responsible for, and hereby disclaim, any injury or damage to any Entrant’s or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Site. In the event of a dispute, Contest Materials will be declared as submitted by the Authorized Account Holder of the email address used or the password/username used to submit the entry at time of entry as solely determined by Revere America. "Authorized Account Holder" is defined as the natural person who is assigned to the email address by the internet access online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address and the password/username is the password/user name selected by a Entrant at time of registration. If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, strikes, acts of God, acts or war or terrorism, events beyond the reasonable control of the Sponsors or any other causes which the Sponsors, in their sole opinion, deem could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select the winner from entries received prior to the action taken or as otherwise may be deemed fair and equitable by the Sponsors.
  • 12.2 IN NO EVENT WILL THE SPONSORS BE RESPONSIBLE OR LIABLE FOR ANY LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY ACCESS TO OR USE OF THE SITE OR THE DOWNLOADING FROM, UPLOADING TO, AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED "AS-IS, WHERE-IS, WITH ALL FAULTS"; WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND WITH NO GUARANTEE THAT THE SITE WILL BE ERROR FREE OR THAT ANY ERRORS WILL BE CORRECTED. SOME JURISDICTIONS MAY NOT ALLOW OR MAY LIMIT THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

13. Choice of Law/Dispute Resolution:
  • 13.1. Except where prohibited, by participating in the Contest or registering at the Site, Entrant (and if the participant is a group each group member) agrees that: By registering for an account and/or participating in any contest offered on the Site signifies Entrant’s knowledge of and agreement to be bound by the most current version of these Official Rules. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant(s) shall be governed by and construed exclusively in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of law in any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Contest shall be filed only in the state or federal courts located in Collier County in the State of Florida and Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by using the Site or participating in this Contest Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action and without use of a jury (Entrant hereby waives any right to a jury trial);  (b) any and all claims, judgments and awards shall be limited to, and the maximum aggregate liability of the Sponsors to any Entrant or Site visitor shall be limited to, the lesser of (i) Entrant’s actual out-of-pocket costs incurred in preparing and submitting the Contest Materials in accordance with the Official Rules (including costs associated with participating in this Contest but in no event attorneys' fees) and (ii) Five Hundred Dollars ($500); and (c) under no circumstances will any Entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

14. Information/Terms of Use/Questions:
  • 14.1. Sponsors reserve the right to share Entrant information with Sponsors and Administrators in accordance with the Privacy Policy applicable to this Contest and available at http://www.revereamerica.org/Contest-Privacy-Policy.aspx, and any such information will be subject to that Privacy Policy. Except as otherwise set forth above, the Site's Terms of Use governs all online participation in this Contest.

15. ANY ATTEMPT BY AN ENTRANT OR OTHER PERSON TO DAMAGE ANY WEB SITE ASSOCIATED WITH THE SPONSOR OR ITS AGENTS OR UNDERMINING THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

16. Winners List:

  • 16.1. The name of the Winners will be posted on the Site within two weeks after the conclusion of the Contest. 

The Contest is void where prohibited or restricted by law.
